The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Fonte Boa and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Fonte Boa, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
This creates what is called a plurality of succession forums: probate in the country of domicile covers the assets there, and the Brazilian one covers the assets here, each with its own applicable law and tax. Heirs living abroad take part in the Brazilian proceeding through a consular or apostilled power of attorney, with no need to come to the country.
An open probate, a property to sell, a divorce to formalize, a record to correct and an account to regularize are pending matters that are often left behind when moving abroad. None of them requires physical presence. A power of attorney executed at a Brazilian consulate, or made abroad and apostilled, allows representation before registry offices, public bodies and court proceedings.
The child of a Brazilian born abroad is registered at the competent Brazilian consulate, and the consular certificate is then transcribed at a Civil Registry in Brazil. Transcription is what allows the record to have full domestic effect, including issuing documents, school enrollment and inheritance matters.
