Private international law defines which law applies, which authority has jurisdiction and what must be done for a foreign act to have effect in Brazil. For those with roots in Caculé - BA and a life abroad, this definition comes before any practical step, because it determines whether the route is the registry office, the STJ or a Brazilian court.
Registry and notary fees follow the state inspectorate's table and are updated periodically. Confirm the current amounts before any notarial or registry act.
The work is defined according to the documents, the risks and the client's goal.
Recognition of a foreign judgment by the STJ

Probate in Brazil of assets of a deceased person domiciled abroad
Divorce in Brazil for those living abroad

Representation of an heir living outside the country
Direct annotation of a foreign uncontested divorce at the registry office
Sale and regularization of property in Brazil by those living abroad
Consular and apostilled powers of attorney for acts in Brazil

The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Caculé and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
This creates what is called a plurality of succession forums: probate in the country of domicile covers the assets there, and the Brazilian one covers the assets here, each with its own applicable law and tax. Heirs living abroad take part in the Brazilian proceeding through a consular or apostilled power of attorney, with no need to come to the country.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Caculé, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
The order of the steps matters: apostilling after translating, or translating from a copy without an apostille, usually results in rejection and rework. Birth, marriage and death certificates, judgments, powers of attorney and diplomas follow the same procedure, with specific requirements from each recipient.
An acknowledgment made abroad must be transcribed to have effect in Brazil. If there is no voluntary acknowledgment, a paternity suit is possible, and it proceeds even with the other party living abroad, through service by the appropriate route, including international legal cooperation mechanisms.
