The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Teixeira de Freitas and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Teixeira de Freitas, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
Complementary Law 227/2026 filled the gap identified by the Supreme Federal Court in Theme 825 and defined which state is competent to levy ITCMD (inheritance and gift tax) in situations with an element abroad. In the inheritance of a deceased person domiciled abroad, the tax belongs to the state where the heir is domiciled; in a gift coming from abroad, to the state of the recipient. Collection on these terms still depends on state law and the tax anteriority rule.
An open probate, a property to sell, a divorce to formalize, a record to correct and an account to regularize are pending matters that are often left behind when moving abroad. None of them requires physical presence. A power of attorney executed at a Brazilian consulate, or made abroad and apostilled, allows representation before registry offices, public bodies and court proceedings.
The order of the steps matters: apostilling after translating, or translating from a copy without an apostille, usually results in rejection and rework. Birth, marriage and death certificates, judgments, powers of attorney and diplomas follow the same procedure, with specific requirements from each recipient.
