This creates what is called a plurality of succession forums: probate in the country of domicile covers the assets there, and the Brazilian one covers the assets here, each with its own applicable law and tax. Heirs living abroad take part in the Brazilian proceeding through a consular or apostilled power of attorney, with no need to come to the country.
The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Santo Antônio da Barra and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
The rule in art. 961 of the Code of Civil Procedure is that a foreign decision only has effect in Brazil after recognition by the STJ. Paragraph 5 of the same article opens a relevant exception: a foreign judgment of uncontested divorce has effect regardless of recognition. In practice, this separates two routes with very different costs and timelines, and sorting between them is the first thing to do.
Name, support and inheritance rights derive from parentage, and none of these effects is lost because of distance. The production of evidence, including genetic testing, is organized considering where each party lives and the cost of travel.
The alternative of divorcing in the country of residence has a consequence: the foreign judgment will later need to be annotated or recognized in Brazil to be valid here. Comparing both routes before starting avoids doing the same procedure twice, in two countries, with two costs.
The Brazilian Ministry of Foreign Affairs estimates around 5.3 million Brazilians living outside the country, and the Federal Revenue Service received about 144 thousand declarations of definitive departure in the latest survey. Many of these people keep assets, records and proceedings in Brazil. For those who left Santo Antônio da Barra, service is provided in the client's time zone, with a power of attorney and digital follow-up.
