A marriage celebrated abroad is valid, but it only has full effect in Brazil after it is registered here. The usual sequence is registration at the Brazilian consulate of the country of celebration and then transcription of the certificate at the competent Civil Registry in Brazil. Without that transcription, the marriage does not appear on Brazilian certificates and cannot be annotated or dissolved in the country.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Congonhas do Norte, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
Complementary Law 227/2026 filled the gap identified by the Supreme Federal Court in Theme 825 and defined which state is competent to levy ITCMD (inheritance and gift tax) in situations with an element abroad. In the inheritance of a deceased person domiciled abroad, the tax belongs to the state where the heir is domiciled; in a gift coming from abroad, to the state of the recipient. Collection on these terms still depends on state law and the tax anteriority rule.
The Brazilian Ministry of Foreign Affairs estimates around 5.3 million Brazilians living outside the country, and the Federal Revenue Service received about 144 thousand declarations of definitive departure in the latest survey. Many of these people keep assets, records and proceedings in Brazil. The alternative of divorcing in the country of residence has a consequence: the foreign judgment will later need to be annotated or recognized in Brazil to be valid here. Comparing both routes before starting avoids doing the same procedure twice, in two countries, with two costs.
The child of a Brazilian born abroad is registered at the competent Brazilian consulate, and the consular certificate is then transcribed at a Civil Registry in Brazil. Transcription is what allows the record to have full domestic effect, including issuing documents, school enrollment and inheritance matters.
