Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Garrafão do Norte, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Garrafão do Norte and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
Assets located in Brazil are probated in Brazil. Art. 23, II, of the Code of Civil Procedure gives the Brazilian authority, to the exclusion of any other, jurisdiction over probate and division of assets located here, even if the deceased was a foreigner or domiciled abroad. Property in Garrafão do Norte owned by someone who died in another country is therefore not resolved by the foreign decision: it requires a Brazilian proceeding.
The order of the steps matters: apostilling after translating, or translating from a copy without an apostille, usually results in rejection and rework. Birth, marriage and death certificates, judgments, powers of attorney and diplomas follow the same procedure, with specific requirements from each recipient.
The child of a Brazilian born abroad is registered at the competent Brazilian consulate, and the consular certificate is then transcribed at a Civil Registry in Brazil. Transcription is what allows the record to have full domestic effect, including issuing documents, school enrollment and inheritance matters.
The Brazilian Ministry of Foreign Affairs estimates around 5.3 million Brazilians living outside the country, and the Federal Revenue Service received about 144 thousand declarations of definitive departure in the latest survey. Many of these people keep assets, records and proceedings in Brazil. For those who left Garrafão do Norte, service is provided in the client's time zone, with a power of attorney and digital follow-up.
