A foreign document has no automatic effect in Brazil, and an act performed outside the country usually requires a step here to be valid. Two situations come up often: those who live in Francisco Macedo and married, divorced or inherited abroad, and those who left Francisco Macedo and need to resolve something that stayed in Brazil. CK Advogadas works on both.

The rule in art. 961 of the Code of Civil Procedure is that a foreign decision only has effect in Brazil after recognition by the STJ. Paragraph 5 of the same article opens a relevant exception: a foreign judgment of uncontested divorce has effect regardless of recognition. In practice, this separates two routes with very different costs and timelines, and sorting between them is the first thing to do.
The property regime does not automatically follow the law of the country of the ceremony. Art. 7, §4, of the Law of Introduction to the Norms of Brazilian Law provides that the regime follows the law of the spouses' domicile and, if different, that of the first marital domicile. The consequence appears years later, in the division of assets or probate, when it is discussed what was common and what was separate property.
This creates what is called a plurality of succession forums: probate in the country of domicile covers the assets there, and the Brazilian one covers the assets here, each with its own applicable law and tax. Heirs living abroad take part in the Brazilian proceeding through a consular or apostilled power of attorney, with no need to come to the country.
Name, support and inheritance rights derive from parentage, and none of these effects is lost because of distance. The production of evidence, including genetic testing, is organized considering where each party lives and the cost of travel.
The Brazilian Ministry of Foreign Affairs estimates around 5.3 million Brazilians living outside the country, and the Federal Revenue Service received about 144 thousand declarations of definitive departure in the latest survey. Many of these people keep assets, records and proceedings in Brazil. For those who left Francisco Macedo, service is provided in the client's time zone, with a power of attorney and digital follow-up.
