The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Jardim Olinda and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in Jardim Olinda, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
Assets located in Brazil are probated in Brazil. Art. 23, II, of the Code of Civil Procedure gives the Brazilian authority, to the exclusion of any other, jurisdiction over probate and division of assets located here, even if the deceased was a foreigner or domiciled abroad. Property in Jardim Olinda owned by someone who died in another country is therefore not resolved by the foreign decision: it requires a Brazilian proceeding.
When consular registration was not done at the time, there is an alternative route for recognition, with its own evidentiary requirements. The assessment takes into account the country of birth, the available documents and the parents' situation at the time of birth.
Name, support and inheritance rights derive from parentage, and none of these effects is lost because of distance. The production of evidence, including genetic testing, is organized considering where each party lives and the cost of travel.
The Brazilian Ministry of Foreign Affairs estimates around 5.3 million Brazilians living outside the country, and the Federal Revenue Service received about 144 thousand declarations of definitive departure in the latest survey. Many of these people keep assets, records and proceedings in Brazil. For those who left Jardim Olinda, service is provided in the client's time zone, with a power of attorney and digital follow-up.
