These situations join two legal systems and almost never require travel. The connection to São Miguel is usually in the civil registry or the property, not in the current address of the person seeking help.

Complementary Law 227/2026 filled the gap identified by the Supreme Federal Court in Theme 825 and defined which state is competent to levy ITCMD (inheritance and gift tax) in situations with an element abroad. In the inheritance of a deceased person domiciled abroad, the tax belongs to the state where the heir is domiciled; in a gift coming from abroad, to the state of the recipient. Collection on these terms still depends on state law and the tax anteriority rule.
The property regime does not automatically follow the law of the country of the ceremony. Art. 7, §4, of the Law of Introduction to the Norms of Brazilian Law provides that the regime follows the law of the spouses' domicile and, if different, that of the first marital domicile. The consequence appears years later, in the division of assets or probate, when it is discussed what was common and what was separate property.
Until this step is taken, the person remains married under Brazilian law. This blocks a new marriage, complicates probate and keeps the marital status outdated in documents. For those who divorced abroad and have the marriage registered in São Miguel, regularization starts with reading the foreign judgment, which defines whether the case is for the registry office or the STJ.
The child of a Brazilian born abroad is registered at the competent Brazilian consulate, and the consular certificate is then transcribed at a Civil Registry in Brazil. Transcription is what allows the record to have full domestic effect, including issuing documents, school enrollment and inheritance matters.
Those who married in Brazil and live abroad can divorce here without coming back. If there is agreement, a public deed at a notary office is possible, with representation by an attorney-in-fact appointed by consular or apostilled instrument. With minor or incapacitated children, the deed requires custody, visitation and support to have already been defined in court. If there is a dispute or these issues are open, the route is judicial, with video hearings when applicable.
The order of the steps matters: apostilling after translating, or translating from a copy without an apostille, usually results in rejection and rework. Birth, marriage and death certificates, judgments, powers of attorney and diplomas follow the same procedure, with specific requirements from each recipient.
