Private international law defines which law applies, which authority has jurisdiction and what must be done for a foreign act to have effect in Brazil. For those with roots in São José do Cerrito - SC and a life abroad, this definition comes before any practical step, because it determines whether the route is the registry office, the STJ or a Brazilian court.
Registry and notary fees follow the state inspectorate's table and are updated periodically. Confirm the current amounts before any notarial or registry act.

The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to São José do Cerrito and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
A simple uncontested divorce, which only dissolves the marriage, goes directly to the Civil Registry where the marriage was transcribed or registered, by annotation governed by the National Code of Rules of the National Inspectorate of Justice. A contested divorce, and a qualified uncontested one that deals with custody, support or division of assets, still depends on recognition by the STJ. The judgment may be recognized in parts.
Complementary Law 227/2026 filled the gap identified by the Supreme Federal Court in Theme 825 and defined which state is competent to levy ITCMD (inheritance and gift tax) in situations with an element abroad. In the inheritance of a deceased person domiciled abroad, the tax belongs to the state where the heir is domiciled; in a gift coming from abroad, to the state of the recipient. Collection on these terms still depends on state law and the tax anteriority rule.
The alternative of divorcing in the country of residence has a consequence: the foreign judgment will later need to be annotated or recognized in Brazil to be valid here. Comparing both routes before starting avoids doing the same procedure twice, in two countries, with two costs.
An open probate, a property to sell, a divorce to formalize, a record to correct and an account to regularize are pending matters that are often left behind when moving abroad. None of them requires physical presence. A power of attorney executed at a Brazilian consulate, or made abroad and apostilled, allows representation before registry offices, public bodies and court proceedings.
The order of the steps matters: apostilling after translating, or translating from a copy without an apostille, usually results in rejection and rework. Birth, marriage and death certificates, judgments, powers of attorney and diplomas follow the same procedure, with specific requirements from each recipient.
