Private international law defines which law applies, which authority has jurisdiction and what must be done for a foreign act to have effect in Brazil. For those with roots in Santa Adélia - SP and a life abroad, this definition comes before any practical step, because it determines whether the route is the registry office, the STJ or a Brazilian court.
Registry and notary fees follow the state inspectorate's table and are updated periodically. Confirm the current amounts before any notarial or registry act.

The field of international law covers legal situations connected to Brazil and another country. See the most requested international law services in Santa Adélia, São Paulo.
This creates what is called a plurality of succession forums: probate in the country of domicile covers the assets there, and the Brazilian one covers the assets here, each with its own applicable law and tax. Heirs living abroad take part in the Brazilian proceeding through a consular or apostilled power of attorney, with no need to come to the country.
The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to Santa Adélia and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
A simple uncontested divorce, which only dissolves the marriage, goes directly to the Civil Registry where the marriage was transcribed or registered, by annotation governed by the National Code of Rules of the National Inspectorate of Justice. A contested divorce, and a qualified uncontested one that deals with custody, support or division of assets, still depends on recognition by the STJ. The judgment may be recognized in parts.
Name, support and inheritance rights derive from parentage, and none of these effects is lost because of distance. The production of evidence, including genetic testing, is organized considering where each party lives and the cost of travel.
An open probate, a property to sell, a divorce to formalize, a record to correct and an account to regularize are pending matters that are often left behind when moving abroad. None of them requires physical presence. A power of attorney executed at a Brazilian consulate, or made abroad and apostilled, allows representation before registry offices, public bodies and court proceedings.
A document issued in a country that is party to the Hague Convention needs an apostille affixed in the country of origin to be accepted in Brazil, plus a sworn translation into Portuguese. A Brazilian document to be used abroad follows the reverse path, with an apostille from an authorized registry office in Brazil. Non-signatory countries follow consular legalization, which is slower.
