A foreign document has no automatic effect in Brazil, and an act performed outside the country usually requires a step here to be valid. Two situations come up often: those who live in São José do Rio Preto and married, divorced or inherited abroad, and those who left São José do Rio Preto and need to resolve something that stayed in Brazil. CK Advogadas works on both.

Complementary Law 227/2026 filled the gap identified by the Supreme Federal Court in Theme 825 and defined which state is competent to levy ITCMD (inheritance and gift tax) in situations with an element abroad. In the inheritance of a deceased person domiciled abroad, the tax belongs to the state where the heir is domiciled; in a gift coming from abroad, to the state of the recipient. Collection on these terms still depends on state law and the tax anteriority rule.
The rule in art. 961 of the Code of Civil Procedure is that a foreign decision only has effect in Brazil after recognition by the STJ. Paragraph 5 of the same article opens a relevant exception: a foreign judgment of uncontested divorce has effect regardless of recognition. In practice, this separates two routes with very different costs and timelines, and sorting between them is the first thing to do.
The pending issue is usually discovered at the wrong time: when buying property, opening probate or filing for divorce. Those whose civil records are tied to São José do Rio Preto and who married abroad resolve it with consular registration, apostille, sworn translation and transcription. It is sequential paperwork, and the order of the steps is what causes the most delay when done without guidance.
A document issued in a country that is party to the Hague Convention needs an apostille affixed in the country of origin to be accepted in Brazil, plus a sworn translation into Portuguese. A Brazilian document to be used abroad follows the reverse path, with an apostille from an authorized registry office in Brazil. Non-signatory countries follow consular legalization, which is slower.
The child of a Brazilian born abroad is registered at the competent Brazilian consulate, and the consular certificate is then transcribed at a Civil Registry in Brazil. Transcription is what allows the record to have full domestic effect, including issuing documents, school enrollment and inheritance matters.
